3.7.7.1.Referral

(1) A registered code agency shall refer a matter under subsection 14(5) of the Act to the chief building official by giving the chief building official, as soon as possible, (a) a report that contains the following information: (i) a copy of the order made under section 12 or 13 of the Act that was not complied with and of the order under section 14 of the Act, (ii) the persons on whom the orders were served and the date and manner of service, (iii) a statement that the orders have not been complied with, and (iv) the efforts made by the registered code agency to achieve compliance with the orders by the persons responsible for compliance, and (b) such other information as the chief building official may require in respect of the matter that has been referred. (2) The report under Clause (1)(a) shall be signed, in accordance with the quality management plan described in Clause 3.4.3.2.(1)(d), by the registered code agency or, if the registered code agency is a corporation or partnership, by a person who has the qualifications set out in Clause 3.4.3.2.(1)(a).
